I am not sure what is wrong with the intellectual property statement we have up when you sign up to the forum. The content you post is yours to post elsewhere there is nothing wrong with that. It looks pretty clear to me the way it was explained. The info is posted to share with other people on this forum and well anyone who searches it out on the internet. If you posted it to share it I don't understand where there should be paranoia about it being on the site. we have not and will not republish and sell your posts or threads.
Sorry if I don't completely agree with you on that statement.
OK, lets take this apart a little, shall we , the first one.
Preservation of Intellectual Property Rights
All material on this site, including, but not limited to images, illustrations and multimedia materials, is protected by copyrights which are owned and controlled by FORDMUSCLEFORUMS.COM...
This Clearly states that FORDMUSCLEFORUMS OWNES the CR on all media on the site.
... or by other parties that have licensed their material to FORDMUSCLEFORUMS.COM.
here it states that some of the CR may be held by other parties, and licensed to FMF, It does not
say who those parties are, and that is worrysome.
....Material from this Web Site or from any other web site owned, operated, licensed or controlled by VerticalScope Inc. may not be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way. Modification of the materials or use of the materials for any other purpose is a violation of the copyrights and other proprietary rights held by the respective providers thereof. The use of any such material on any other web site, ftp server or network environment is prohibited.
The rest is basic "you can't use it elswhwere" BS.
The following TOS is not from Fordmuscleforums
Now Lets look at the second one I posted.
You represent and warrant that: (i) you own the content posted by you on or through the Site or otherwise have the right to grant the license set forth below, and ...
Right in the first line, it states the poster ownes ALL his/her content. It doesn't get any clearer that that , does it?
...(ii) the Posting of your content does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person.
ensures that if a persons posted content violates someone else, the forum can remove it. It could have been writen a little more clearer, but maybe it is vauge on purpose.
By displaying or posting content on the Site, you hereby grant us a nonexclusive global license to publish the content submitted by you to the Site.
Pretty clear here, ther poster gives the right to the forum to publish, NON EXCLUSIVELY. The first one didn't mention this.
You also grant us global nonexclusive adaptation and resale rights over any content and material submitted to the Site.
Not too fond of the adaptation rights, a users work should stay whole, and unaltered
These nonexclusive publishing license and resale/adaptation rights extend to any materials submitted "for publication" within the Site, including both message board postings and content submitted for uploading and subsequent publishing within non-message board portions of the Site. Neither we nor our staff will be responsible for any misleading, false or otherwise injurious information and advice communicated on the Site or for any results obtained from the use of such information or advice. We will not be liable for any loss or damage suffered by a user through the user's reliance on information and advice gained on the Site.
Basic cover you ass move by the forum.
Neither of these two are perfect, BUT one definately favors the forum. I would like to see in the statement that that poster owns the rights to his/her work. and that FMF and verticlescope do not have an exclusive right to that work.
